I decided to close the year out with a summary of new Criminal Laws enacted by the NY Legislature for 2011. My favorite: The New York State Child Passenger Protection Act, commonly referred to as Leandra's Law. The law was enacted in response to the October 2009 accident when Leandra Rosado was thrown from a car that was driven by a drunk driver. I ended my "family law" series with the dreaded "D" word: Divorce. If you live in New York, you might be surprised to know that the state has finally adopted a no-fault divorce policy. This means that a couple need not prove any wrongdoing or abuse to file for divorce in a court of law. Many though believe that the NY legislature did not think this change all the way through. You have a moral, and sometimes a legal responsibility, to report any hints of either to the Administration for Child Services, or you local police precinct. Please do. It was nice to see Councilman Vacca at the BronxNet Studio this morning. As promised, I continued my "Family Law" series, focusing on the topic of "Adoption". There are a few different ways to bring a child into your life, or confirm your legal relationship with one, through adoption. The best advice I can give, get an attorney that specializes in the area! A prenuptial/premarital agreement is a written contract created by two people planning to be married. The agreement typically lists all of the property each person owns, as well as their debts, and it specifies what each person's property rights will be after they tie the knot. There are an estimated 500,000 frozen embryos currently maintained in Cyberpreservation storage. That number has increased every year since 2003. One can reasonably expect that number to increase given the advances in technology, and the fact that more couples are seeking fertility treatment. With this increase in the number of frozen embryos available for adoption comes an assortment of legal issues. I really had hoped on ending my criminal law series last week. That was before I received a call from a client who asked me: "why haven't you discussed the rights of inmates at Rikers"? Good question. So, this morning I delved into the federal and state laws that govern the establishment and administration of prisons. Courts tend to give deference to prison officials regarding prisoners' rights. As long as the conditons or degree of a prisoner's confinement are within the sentence and not otherwise violative of the constitution. I ended my criminal law series today. I gave a synopsis of your right to privacy when the police come knocking, pull you over, or stop you on the street. Courts ask two questions to determine whether a person had an expectation of privacy in the place or things searched: Did the person expect some degree of privacy, and is the person's expectation reasonable? What criminal law series would be complete without discussing the 4th Amendment, more commonly known as the right against unlawful "searches and seizures." Today on "Open", I defined certain legal terms: "probable cause", "warrants", "right of Privacy". The history of the 4th amendment could take months to explore. Let's just say, many judges look at your right against unlawful searches and seizures rather differently. Next week, we get into the actual scenerios. Stay tuned.

After K-Rod was hit with criminal charges on Wednesday after breaking an Order of Protection barring him from contacting the mother of his estranged girlfriend, I thought the topic would be ripe for "Open". This morning I discussed the court orders that are designed to stop violent and harassing behavior and protect you and your family from an abuser. In NY, you can get an Order of Protection in Family Court, Criminal Court, or Supreme Court. But note, not everyone is eligible to apply in Supreme Court. So make sure you head to the proper venue. Bed bug infestations have been on the increase in recent weeks. These critters feed on the blood of animals including people and pets. They can survive for up to 18 months without feeding! This morning on "Open", I gave a mini lecture on your right to sue a landlord if your apartment is crawling with bed bugs. With the new law passed on August 31st, landlords in NY must now disclose to prospective tenants whether or not a building has the dreaded insect. My advice to the viewers, get to a hospital asap if you think you have been bitten. And make sure you are properly diagnosed as having a "bed bugs" bite. Not a "scabies" bite. Although you can make an argument that a traffic violation is just that, a violation, not a crime. It had been awhile since I hosted "Open". I was glad to do it. We had some wonderful guests on the morning show. And, I was able to continue discussing Landlord/Tenant rights, specifically, fighting rental housing discrimination. I made sure the viewers know their rights, and understand how to file a complaint. It as been almost 27 years since the passage of the Pet Law. This law has been very uselful in protecting pets and their owners. Pet owners should not be discouraged by "No Pet" clauses in their leases. Various laws, including the Pet Law, overrride these clauses. It was nice meeting the Comptroller at BronxNet Studios this morning. John Liu made some interesting points concerning New York's "Checkbook NYC Initiative". In the meantime, this morning I shed light on one of the oldest legal doctrines: "nuisance". In particular, how a neighbor's actions can interfere with your right to enjoy your real property. Whether its noise, odors, or even a tree limb, you have a right to enjoy your apartment or house. The doctrine of "nuisance", is a tenant's best friend. David Lesch

After a few weeks off, it was time to get back to business. This morning on "Open", my discussion of "tenant's rights" moved from the lease itself to the apartment. The "Warranty of Habitability" covers many areas: lead paint, security, repairs, and of course the basics such as heat and hot water. As a tenant you have rights. Make sure you document any violations of your warranty. In this way, when you are in housing court you will have a paper trail to show the judge. David Lesch

The internet is a dangerous place, especially for children. Since 1996, Congress has passed several laws that try to address sexually explicit materials found on the net. But most have been found unconstitutional. I discussed this morning on "Open" ways to protect your child from sexual predation found on the internet. The best advice: spyware. Recently,there has been a big push to make automobile power windows safer. This morning on "Open", I discussed this danger, and why a power window can seriously hurt a child. Either by leaning on the switch, or when a parent accidentally closes a rear window, a child can easily become trapped by the pane. The answer: automatic reverse features that are standard on most European and Japanese vehicles. Hopefully legislation will be introduced in the U.S. to force car manufacturers to implement this feature! David Lesch

This morning on "Open", I returned to a series that I began a few months ago: Dangers Facing Children and Laws that Protect Them. I'm sure its no surprise that the most common type of danger that faces children are those that also involve motor vehicle collisions. So this morning I gave a rundown of the things a parent should do to make sure their child is safely riding as a passenger (and isn't hit while standing behind the car when the car is in reverse). This morning on "Open", we had a terrific show. I finished my three part series on consumer fraud. I first discussed the dangers of debit cards and finished the segment discussing bank overdraft fees. It is very important that you read the fine print any time you apply for a debit card. In addition, if you do want bank overdraft protection, find out exactly how much you will be charged in the event you go over the amount of funds in your account.
We had a great show last night. Our guest on "BronxLegal", Anthony Rivieccio, founder and CEO of the Bronx based consulting firm, The Financial Advisors Group. We discussed the present state of the economy, as well as much needed tax tips. The best advice of the evening, always ask about potential deductions.....and file, even if you don't think you earned enough money.

Today on "Open" I continued discussing "consumer fraud", in particular, "financial fraud" and the internet. Afterall, how many times are you asked to "purchase" a stock on the internet. The best advice I can give, if you are looking to invest in a particular stock or venture, is to reach out to the company directly and ask to see research on "product development". And don't trust anyone to do the research for you, not even your broker! Next week I will continue the series, the topic: debit cards, and the financial pitfalls.
Great live "BronxLegal" last night! Thanks to "BronxWorks" and "The Muslim Women's Institute For Research and Development" for coming on the show to discuss the Haitian relief efforts. It was nice to be back in the studio. New year, new legal topics. Today I thought "Copyright" was ripe for discussion. In particular, the common misconceptions concerning copyright laws. I commented on the mistaken beliefs many have regarding the use of another person's material. There are six common misperceptions. With a studio audience in the background, many on the set realized that they might be violating another person's copyright protections, even if accidentally.
