There are many couples that never make it to the altar because they began their negotiations a few weeks before their wedding day. My best advice is to have the discussion immediately after getting engaged because the closer you get to the big day, the more pressure you're going to have to get the agreement done. For the next few months, I will be discussing 'Municipal Liability", which covers a wide range of topics. Many train and subway accidents occur as a result of preventable human error and some are even due to defective equipment. The weather is too beautiful to not start thinking about Spring!  However, with the warmth comes the issue of moisture buildup in apartments.  This might bring mold, sometimes "toxic", which can be very dangerous to your health.  This morining on "Open" I discussed your right to a "mold free" apartment, and the possibility that an action exists against your landlord for failure to maintain your "warranty of habitability". Carbon monoxide is a colorless, odorless gas that can cause brain damage and, in severe cases, death.    NY now has a strict law mandating the placement of a detector within 15 feet of a bedroom. The city is in a state of blizzard!  There are five types of ski cases:  Collision Cases, Lift Cases, Fall Cases, Instructor Cases, and Equipment Cases. My favorite:  The New York State Child Passenger Protection Act, commonly referred to as Leandra's Law.  The law was enacted in response to the October 2009 accident when Leandra Rosado was thrown from a car that was driven by a drunk driver. If you live in New York, you might be surprised to know that the state has finally adopted a no-fault divorce policy. As promised, I continued my "Family Law" series, focusing on the topic of "Adoption".  There are a few different ways to bring a child into your life, or confirm your legal relationship with one, through adoption.  The best advice I can give, get an attorney that specializes in the area!  He or she will guide you through the process and let you know whether you are better suited to pursue an agency or independent adoption. The agreement typically lists all of the property each person owns, as well as their debts, and it specifies what each person's property rights will be after they tie the knot. That number has increased every year since 2003. One can reasonably expect that number to increase given the advances in technology, and the fact that more couples are seeking fertility treatment. That was before I received a call from a client who asked me:  "why haven't you discussed the rights of inmates at Rikers"?  Good question.  So, this morning I delved into the federal and state laws that govern the establishment and administration of prisons.   Courts tend to give deference to prison officials regarding prisoners' rights.  As long as the conditons or degree of a prisoner's confinement are within the sentence and not otherwise violative of the constitution.   In otherwords, as a prisoner you do have rights, but the rights are pretty basic.   Tune in tonight for the details. Courts ask two questions to determine whether a person had an expectation of privacy in the place or things searched:  Did the person expect some degree of privacy, and is the person's expectation reasonable? In NY, you can get an Order of Protection in Family Court, Criminal Court, or Supreme Court.  But note, not everyone is eligible to apply in Supreme Court. These critters feed on the blood of animals including people and pets.  They can survive for up to 18 months without feeding!  This morning on "Open", I gave a mini lecture on your right to sue a landlord if your apartment is crawling with bed bugs.   With the new law passed on August 31st, landlords in NY must now disclose to prospective tenants whether or not a building has the dreaded insect.  My advice to the viewers, get to a hospital asap if you think you have been bitten.  And make sure you are properly diagnosed as having a "bed bugs" bite.  Not a "scabies" bite.  Many a landlord has tried to shift responsibility by suggesting a tenant was bit by a different type of but. This law has been very uselful in protecting pets and their owners.  Pet owners should not be discouraged by "No Pet" clauses in their leases. This morning on "Open", I discussed this danger, and why a power window can seriously hurt a child.  Either by leaning on the switch, or when a parent accidentally closes a rear window, a child can easily become trapped by the pane.  The answer:  automatic reverse features that are standard on most European and Japanese vehicles.  Hopefully legislation will be introduced in the U.S. to force car manufacturers to implement this feature! Afterall, how many times are you asked to "purchase" a stock on the internet.  The best advice I can give, if you are looking to invest in a particular stock or venture, is to reach out to the company directly and ask to see research on "product development".  And don't trust anyone to do the research for you, not even your broker! "BronxLegal with David Lesch" had a great show last night with Criminal Attorney Peter Tillem of the firm Tillem and Campbell. As promised we discussed the present state of Gun Possession Laws in NY State. A very controversial topic. Especially with the fallout following the Plexico Burress plea. This morning, on the show "Open" I concluded my four part series focusing on controversial laws everyday new yorkers must face. A few months ago the Rockefeller Drug laws were modified. Certainly controversial, these laws have been a political hot potato. Today I was able to give both sides of the debate. The host, Darren Jaime, had some interesting questions for me. Although Judges in NY now have more power in determining sentencing for non violent, first time, drug offenders, I'm sure we have not heard the last of the call for further modification of the law. Finally, immediately after "Open", I appeared on "Perspectives". The topic, the upcoming terrorist trial in lower manhattan. Talk about cotroversial. The ultimate issue: are the terrorists considered "solders" or "criminals"? Or both. NY's Gun Possession law, which will be broken down on next week's "BronxLegal", was the topic.   The presumptions created by the legislature with regard to who a gun belongs to is what makes the law so controversial.  Many people believe the mandatory sentence of one year is the reason the law is so controversial.  I disagree.  The law automatically deems you in possession of a gun if you are found in the same car as the weapon.  Even if you had never met the occupants in the car, and never had knowledge of the background of your fellow passengers.  The presumption that all are "deemed" in possession of the gun is the real controversy.
